What is Probate?

With all the recent news about what will happen with estate taxes, the process of probate has come up quite a bit.  Sometimes probate is mentioned in a low-key, matter-of-fact kind of way; at other times it is presented as something scary, and to be avoided at all costs. We know our readers have seen the term often enough, but under the circumstances we thought it a good idea to go back to basics, and have a discussion of exactly what is probate, and what’s all the fuss?

Probate is the process by which the court identifies the assets of a person who has died, and facilitates the distribution of those assets  and transfer of title to the persons entitled to them. It sounds like it should be simple, but even in the best of circumstances there are procedures that must be followed to the letter, and the actual process (depending on the size of the estate and the laws of the state in which the property is being probated) can take anywhere from 6 months to a few years.

President of the Active 20-30 Club of Redding #143

On June 25th 2011, Mr. Jesrani was installed as the President of The Active 20-30 Club of Redding.  The Active 20-30 Club is a National Service Organization, with young professionals who serve the special needs of children in their local communities.  As you have seen on other blog posts on this page, Mr. Jesrani and the 20-30 Club have work incredibly hard to improve the children living in the City of Redding through fundraising efforts, charitable contributions, and playground builds.

ATTN: Landords, Sellers, Property Managers, Hotel Owners: California Law To Require Carbon Monoxide Detectors

As of July 1, 2011, all existing single-family dwelling units must have installed a carbon monoxide detector.  

This bill deals with existing housing. (New construction standards are set by state agencies.) It covers every "dwelling unit intended for human occupancy" which means single-family housing, factory-built homes, condominiums, motels, hotels, dormitories, and dwelling units in "multiple-unit dwelling unit buildings" (apartment houses). It applies to every dwelling unit that has "a fossil fuel burning heater or appliance, fireplace, or an attached garage". "Fossil fuel" means "coal, kerosene, oil, wood, fuel gases, and other petroleum or hydrocarbon products, which emit carbon monoxide as a byproduct of combustion." In other words, unless you live in an all-electric home with a detached garage and you don't use a hibachi, you are covered by this law.
